Please read these Terms & Conditions carefully before using the Nizam platform. By creating an account or using our services, you agree to be bound by these terms.
1. Acceptance of Terms
By accessing or using the Nizam platform — including the website at www.nizamco.com, the web application at app.nizamco.com, and the Nizam Android application — you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, please discontinue use immediately.
2. Description of Service
Nizam is a residential complex management platform that allows complex administrators and residents to manage maintenance billing, payment collection, resident records, committee roles, notices, and emergency SOS alerts. We reserve the right to modify, suspend, or discontinue any aspect of the service at any time with reasonable notice.
3. User Accounts & Registration
- You must provide accurate and complete information when registering.
- You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
- You must notify us immediately if you suspect unauthorised access to your account at [email protected].
- You must be at least 18 years old to create an account.
- One person or entity may not maintain more than one account unless authorised by Nizam.
4. Acceptable Use
You agree not to:
- Use the platform for any unlawful purpose or in violation of any applicable law.
- Upload or transmit viruses, malware, or any code designed to harm the platform or its users.
- Attempt to gain unauthorised access to any part of the platform or another user's data.
- Scrape, crawl, or extract data from the platform without our written consent.
- Harass, threaten, or intimidate other users via in-app messaging or notices.
- Use the SOS alert feature for non-emergency, malicious, or prank purposes.
- Reverse engineer, decompile, or disassemble any part of the platform.
- Resell or sublicense access to the platform without our express written permission.
5. Administrator Responsibilities
Complex administrators who manage a complex on the Nizam platform agree to:
- Obtain appropriate consent from residents before adding their personal information to the platform.
- Use resident data only for the purpose of complex administration.
- Keep resident data accurate and up to date.
- Ensure the platform is used in compliance with applicable local laws regarding data protection and property management.
- Not share administrator credentials with unauthorised parties.
6. Billing & Payments
Nizam charges subscription fees for platform access. Current pricing is available at nizamco.com/#pricing.
- Subscription fees are charged in Pakistani Rupees (PKR) unless otherwise stated.
- All payments are due in advance of the subscription period.
- We reserve the right to change pricing with 30 days' notice. Continued use after the effective date constitutes acceptance of the new pricing.
- Nizam is not responsible for fees charged by third-party payment processors.
- Refunds are granted at our discretion. Contact [email protected] for billing disputes.
7. Free Trial
New accounts receive a 2-month free trial with full platform access. No credit card or payment information is required to start the trial. At the end of the trial period:
- You will be notified before the trial ends.
- Access will continue uninterrupted if you choose a paid plan.
- If no plan is selected, access will be restricted to read-only mode until a subscription is activated.
- Data is retained for 90 days after trial expiry before deletion.
8. Intellectual Property
All content, software, designs, trademarks, and trade names on the Nizam platform are the exclusive property of Nizam or our licensors. You are granted a limited, non-exclusive, non-transferable licence to use the platform for its intended purpose only.
You retain ownership of data you upload to the platform (resident records, billing data, etc.). By uploading such data, you grant us a licence to process and store it for the purpose of providing the service.
9. Disclaimer of Warranties
The Nizam platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the platform will be uninterrupted, error-free, or free from viruses. We strive for 99.9% uptime but do not guarantee it contractually in the standard subscription plan.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Nizam and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or business interruption — arising from:
- Your use of or inability to use the platform.
- Any errors, inaccuracies, or omissions in platform content.
- Unauthorised access to your data resulting from your failure to maintain account security.
- Any third-party content or services linked to or integrated with the platform.
Our total liability to you for any claim shall not exceed the fees you paid to us in the 3 months preceding the claim.
11. Termination
We may suspend or terminate your access to the platform at any time, without notice, if you violate these Terms. You may terminate your account at any time by contacting [email protected]. Upon termination:
- Your access to the platform will cease immediately.
- Your data will be retained for 30 days, after which it will be permanently deleted.
- You may request a data export before termination.
- No refunds will be issued for the unused portion of a subscription period, except where required by law.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Pakistan. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Karachi, Pakistan.
13. Changes to Terms
We may update these Terms at any time. For material changes, we will notify you by email or in-app notification at least 14 days before the new Terms take effect. Continued use of the platform after the effective date constitutes your acceptance of the revised Terms. The "Last updated" date at the top of this page reflects the current version.
